In order to invest in the restaurant industry, business entities need to register for a restaurant business license to ensure legal operations. The process of applying for a restaurant business license is usually carried out at the local business management agency. I. Documents for restaurant business registration

1. Business registration for private restaurant enterprises

II. Duration for issuing the restaurant business license

The business registration agency will review the validity of the business registration documents and issue the Certificate of Business Registration within 03 working days from the date of receiving the documents. For the restaurant service industry, you need to supplement the following documents:

  1. Certificate of food safety and hygiene.
  2. Fire safety certificate (if applicable according to the provisions in Appendix 2 of Decree No. 35/2003/ND-CP on detailed regulations for the implementation of the Fire Prevention and Fighting Law).
  3. Retail tobacco sales certificate (if the restaurant sells retail tobacco).

III. Procedures for applying for a food safety and hygiene certificate for a restaurant

1. Documents

– Application for the issuance of a certificate of compliance with food safety and hygiene conditions (Form 1 according to Circular No. 26/2012/TT-BYT).

– Copy of the business registration certificate with the registered food business sector.

– Description of the facilities, equipment, and utensils ensuring food safety and hygiene conditions (with confirmation from the facility), including:

  • Diagram of the layout of the premises and surrounding area.
  • Production process diagram or preservation, distribution process, and description of the facilities, equipment, and utensils of the establishment.

– Training certificate on food safety and hygiene for the owner and directly involved staff in food production and business.

  • For establishments with fewer than 30 people: Submit a certified copy of the training certificate (with confirmation from)
  • For establishments with more than 30 people:

– Submit a list of trained personnel (with confirmation from the facility).

– Health certificates for the owner and directly involved staff in food production and business, issued by district-level or higher healthcare institutions. For areas with circulating diarrhea epidemics as announced by the Ministry of Health, employees directly involved in food production must submit negative test results for intestinal pathogens (such as Salmonella, Shigella, and Campylobacter).

2. Competent authorities

– The Food Safety Agency issues certificates for production and business establishments of functional foods, fortified foods, food additives, and food processing aids (excluding small-scale production and business establishments), as well as other production and business establishments if there are special requirements (based on the importing country’s regulations).

– The Provincial or Central Sub-department of Food Hygiene and Safety issues certificates for:

  • Natural mineral water production and business establishments, bottled drinking water, packaging materials, and direct food contact utensils within the jurisdiction of the healthcare sector.
  • Small-scale production establishments of functional foods, fortified foods, food additives, and food processing aids.
  • Small-scale business establishments of functional foods, fortified foods, food additives, and food processing aids with special product preservation requirements

3. Processing time for application

– Within 5 working days from the date of receiving a complete application dossier, the receiving agency must review its validity. If any errors are found, the issuing agency will notify the business in writing.

– Within 60 days from the date of receiving a notification of an invalid dossier, if the business does not supplement or rectify the issues, the issuing agency will cancel the dossier.

– After evaluating the dossier, the issuing agency will proceed with the evaluation of the establishment within the next 10 days.

– The evaluation team consists of 5-9 members, with only 3-5 members required for small-scale production and business establishments, of which two-thirds must be food safety specialists.

– Evaluation results: If the establishment does not meet the requirements, it will be given 60 days to address the issues stated in the evaluation report. If it meets the requirements, the establishment will receive the Certificate of Compliance within 15 days from the date of successful evaluation.

IV. Validity period of the food hygiene and safety certificate for the restaurant

The Certificate of Compliance with Food Safety and Hygiene Conditions for the establishment is valid for 3 years. Before the certificate expires, within 6 months, organizations or individuals involved in food production and business must submit an application dossier to request a reissuance of the certificate if they wish to continue their production and business activities. The process of submitting the dossier and reissuing the certificate will comply with the procedures and timeframes specified in the decision of the competent authority.
